2005 Legislative Update (as of May 17, 2005)


During the 2005 legislative session, Senate Bill 202 and House Bill 119 were passed. Senate Bill 202 was signed into law by Governor Blunt in April. For House Bill 119 to become law, it must also be signed by the Governor. If he elects not to sign the bill by the deadline, it will automatically become law.

Senate Bill 202: Termination of the ALJLAP

Senate Bill 202 terminates the Administrative Law Judges and Legal Advisors’ Plan (ALJLAP) for new hires. Effective April 26, 2005, new administrative law judges and legal advisors will participate in the Missouri State Employees’ Plan (MSEP) or Missouri State Employees’ Plan 2000 (MSEP 2000), whichever is applicable.

The ALJLAP will no longer be available to those employees:

  • Hired for the first time as an administrative law judge or legal advisor on or after April 26, 2005.
  • Who have not previously participated in the ALJLAP.

Any administrative law judge or legal advisor employed prior to April 26, 2005 will continue to participate in the ALJLAP. This act will not affect the past, present, or future benefits of members who participated in the ALJLAP prior to the effective date of the bill.

House Bill 119: Life Insurance Coverage for Members on Active Military Leave

House Bill 119 allows military personnel to extend their life insurance coverage beyond the current 12 month maximum period. Effective July 1, 2005, state employees may continue their MOSERS life insurance coverage for the duration of deployment when they:

  • Are called to active duty in a time of active armed warfare.
  • Serve as a member of the United States Armed Forces or National Guard.

Coverage is subject to the terms and conditions of the life insurance policy. The monthly premium will be paid by the member.

The 2005 legislative session ended Friday, May 13, without the passage of either SB 466 or HB 334. Therefore, no retirement incentive will be available this year.
